Since long, MSDS is the established information document for dangers and other important properties downstream in the distribution chain. The primary responsibility lays upon the manufacturer (in case it is within the European Union or the EES) or upon the main importer into these countries. The information shall follow the products, however not necessary by physical sending this document upon each delivery.
In practice, the manufacturer, importer, distributor etc, makes them available in digital form, usually as PDF, HTML or TXT files, on the company's home page. There the downstream users can access them, usually in several languages, and then include them into their chemical registry systems.
All data necessary for producing MSDSs are included into KemRisk and hence it is also used for that purpose. Because KemRisk also is a register system other MSDSs are included and key data (e.g. product name, edition date, labelling, composition) is registered in the system. Requirements for the compilation of safety data sheet is regulated in Annex II of REACH which, since May 31, is replaced by a new Regulation 453/2010. This Regulation is effective from December 1, 2010 but it is allowed to be used from June 20. KemRisk will soon be updated according to this Regulation.
Since 2007 a lot of new legislation has appeared and still more is in progress. Earlier an MSDS could be assigned a "best before" date 2-4 years after publication but now you must consider fixed deadlines and revisions should be done more frequent and documents older than 2 years should be considered not to be acceptable.
This fact is not commonly noticed by media and therefore many companies will find that the deadline has passed and their products no longer are classified and labelled correctly.
